Well first off I will admit I know little about this. But they could easily tax it by taxing the isp's themselves. And each isp has to get a license so they know where and who they are. So basically they would tax the isp for every email that went through their system. So if the isp is getting taxed dont tell me they wont push that exspense off on its customers by way of increased rates or a surcharge. So it can be done, however I doubt it will happen.
